Where a Schaumburg case is heard

Schaumburg sits in Cook County, so venue is proper here under 750 ILCS 5/104, which places a case in the county where either party resides. Within Cook County you have two filing locations.

A Cook County resident may file downtown at the Daley Center or, living in a suburban municipal district as you do, in that district's courthouse. Rolling Meadows is the local option for Schaumburg; the downtown Domestic Relations Division remains available.

For a judgment of dissolution, 750 ILCS 5/401 requires 90 days of Illinois residency (or military presence in the state) before judgment is entered. If you recently moved to Schaumburg from out of state, count that period before you set expectations about timing.

What the court will require of you

Parenting education. Cook County's program is Focus on Children, required of litigating parents in dissolution and parentage cases under 750 ILCS 5/404.1 and Illinois Supreme Court Rule 924. It is a four-hour in-person class, with Spanish sessions twice a month and interpreters by arrangement; an online alternative, Children In Between Online, is available. The cost is $50 unless waived by the judge. Register through Family Court Services at (312) 603-1540 or DRD.family@cookcountyil.gov, with a copy of the court order. Mediation. Cook County requires mediation for initial allocation of parental responsibilities, modification of allocation, relocation, and non-parent visitation. Mediation is discretionary for financial and discovery disputes. When parents cannot agree on a mediator for a child-related dispute, Family Court Services handles it; otherwise you may use a court-certified or agreed private mediator. A parenting plan. Under 750 ILCS 5/602.10, a parenting plan is due within 120 days after service or filing. The plan addresses significant decision-making under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7. Start drafting early; the 120 days pass quickly if you wait for mediation to be scheduled first.

Financial disclosure and money issues. Property is divided under 750 ILCS 5/503. Child support follows the income shares calculation in 750 ILCS 5/505. Maintenance, including the guideline formula at 750 ILCS 5/504(b-1), is governed by 750 ILCS 5/504. If you need something decided before the case ends, 750 ILCS 5/501 covers temporary relief, including temporary support and exclusive possession of the marital residence under 501(c-2), and 750 ILCS 5/603.5 covers temporary allocation of parental responsibilities.

After judgment. Support and allocation judgments can be modified under 750 ILCS 5/510. Moving with a child more than 25 miles from a Cook County address is a relocation governed by 750 ILCS 5/609.2 and requires notice and, absent agreement, court approval. Where a child is seriously endangered, 750 ILCS 5/603.10 allows restriction of parental responsibilities.
