How Illinois Maintenance is Calculated in 2026

Under 750 ILCS 5/504, maintenance (formerly alimony) is calculated using a standardized formula for most couples with a combined gross income of less than $500,000.

  • The Formula: Maintenance is calculated as 33.3% of the payer's net income minus 25% of the receiver's net income.
  • The Cap: The maintenance award, when added to the receiver's own income, cannot exceed 40% of the combined net income of both parties.
  • Duration: The length of payments is determined by multiplying the length of the marriage by a statutory factor.
