What Cook County requires of parents and spouses

Parenting education. Cook County requires litigating parents in dissolution and parentage cases to complete Focus on Children, under 750 ILCS 5/404.1 and Illinois Supreme Court Rule 924. It is a four-hour in-person class, with Spanish sessions twice a month and interpreters by arrangement; Children In Between Online is the online alternative. The cost is $50 unless waived by the judge. Register through Family Court Services at (312) 603-1540 or DRD.family@cookcountyil.gov, with a copy of your court order. Doing this early removes one item from the judge's list at your next date.

Mediation. Mediation is mandatory for the initial allocation of parental responsibilities, modification of allocation, relocation, and non-parent visitation. It is discretionary for financial and discovery disputes. When parents cannot agree on a mediator for a child-related dispute, Family Court Services handles it; otherwise the parties may use a court-certified or agreed private mediator. A parenting plan. Each parent must file a proposed parenting plan within 120 days after service or filing (750 ILCS 5/602.10). The plan addresses significant decision-making responsibilities (750 ILCS 5/602.5) and parenting time (750 ILCS 5/602.7). If the parents file a single agreed plan, the court reviews it rather than litigating the issues.

Money. Child support is calculated on the income shares model (750 ILCS 5/505). Maintenance, including the guideline formula, is governed by 750 ILCS 5/504 and 504(b-1). Property is divided under 750 ILCS 5/503. All of that runs on documents: tax returns, pay records, account statements, business records. Start pulling them now, because the pace of a case usually tracks how fast the financial picture becomes clear.

If something cannot wait. Temporary relief — including temporary support and, under 750 ILCS 5/501(c-2), exclusive possession of the marital residence — is available under 750 ILCS 5/501. Temporary allocation of parental responsibilities is available under 750 ILCS 5/603.5, and restriction of parental responsibilities where a child is seriously endangered under 750 ILCS 5/603.10. Moving with a child more than 25 miles from a Cook County address is relocation under 750 ILCS 5/609.2. Post-judgment changes to support or allocation run through 750 ILCS 5/510.
