Where a Hinsdale case is heard

Hinsdale sits in DuPage County, and DuPage domestic relations cases are handled by the 18th Judicial Circuit at the DuPage County Judicial Center, 505 N. County Farm Rd., Wheaton, IL 60187. Two threshold questions come up before anything is filed:

• Venue. Under 750 ILCS 5/104, a dissolution case is brought in the county where either spouse resides. If you live in Hinsdale on the DuPage side, that is DuPage County.
• Residency. Under 750 ILCS 5/401, a judgment of dissolution requires 90 days of Illinois residency, or military presence in the state.

What DuPage County asks of parents and spouses

Parenting education. DuPage uses Caring, Coping and Children, run through the DuPage County Family Center, for all divorcing and never-married parents. It is an online co-parenting course with registration at fcreg.dupagecounty.gov, in English and Spanish. Illinois requires a court-approved parenting education program for parents in dissolution cases under 750 ILCS 5/404.1, and Illinois Supreme Court Rule 924 applies. Register early; this is one of the few requirements you can finish in your first week without waiting on the other side.

Mediation. Mediation is provided by the DuPage County Family Center, 422 N. County Farm Rd., Wheaton, IL 60187, across County Farm Road from the courthouse, at (630) 407-2450. The Family Center also offers supervised parenting time, neutral exchange, and the PEACE class. Hours are Mon–Tue 8:30–5, Wed–Fri 8:30–9 p.m., Sat 8–12:30, Sun 3–8 p.m., which includes evening and weekend times. Illinois Supreme Court Rule 905 governs circuit mediation programs. Parenting plan. Under 750 ILCS 5/602.10, each parent files a proposed parenting plan within 120 days after service or filing. The plan addresses significant decision-making under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7. If you expect to move, read 750 ILCS 5/609.2 first: from a DuPage residence, a move of more than 25 miles is a relocation requiring notice and either agreement or court approval, and 25 miles out of state triggers the same process.

Money and disclosure. Property is divided under 750 ILCS 5/503, maintenance is addressed under 750 ILCS 5/504 including the guideline formula at 504(b-1), and child support follows income shares under 750 ILCS 5/505. Temporary support and exclusive possession of the marital residence under 501(c-2) come from 750 ILCS 5/501; temporary parenting arrangements come from 750 ILCS 5/603.5. After judgment, support and allocation judgments are modified under 750 ILCS 5/510.

A practical step this week: collect three years of tax returns, recent pay records, and statements for every account in your name or held jointly. Disclosure drives most contested issues.

Hinsdale straddles DuPage and Cook

Hinsdale straddles the DuPage–Cook county line. Which courthouse applies depends on the address you actually live at, not the village name on your mail.

• Hinsdale addresses in Cook County: Cook residents use Bridgeview.

This matters before filing, because 750 ILCS 5/104 places venue where a party resides, and the parenting education and mediation programs above are DuPage County programs. If your spouse lives on the Cook side and you live on the DuPage side, both counties may be proper venues. If you are in danger. The Illinois Domestic Violence Hotline is (877) 863-6338. Locally, Family Shelter Service (Metropolitan Family Services) has a hotline at (630) 469-5650. An emergency order of protection can be entered without prior notice under 750 ILCS 60/217, and the remedies a court can order are listed at 750 ILCS 60/214. Where a child is seriously endangered, 750 ILCS 5/603.10 allows the court to restrict parental responsibilities. For parenting services. The DuPage County Family Center at (630) 407-2450 handles mediation, supervised parenting time, neutral exchange, the PEACE class, and Caring, Coping and Children. If exchanges have become a flashpoint, ask about neutral exchange directly rather than waiting for a judge to raise it.
