Where Evanston cases are heard

Evanston sits in Cook County's Second Municipal District. The district courthouse is the Skokie Courthouse at 5600 Old Orchard Rd., Skokie, IL 60077, phone (847) 470-7250, open 8:30 a.m. to 4:30 p.m. It handles divorce proceedings, paternity and child support matters, and divorce-related orders of protection.

The same district serves Deerfield, Des Plaines, Glencoe, Glenview, Golf, Kenilworth, Lincolnwood, Morton Grove, Niles, Northbrook, Northfield, Park Ridge, Skokie, Wilmette, and Winnetka. If the other party lives in one of those towns, you are both within the same district.

Filing in Skokie is an option, not a requirement. A Cook County resident may file downtown at the Richard J. Daley Center, 50 W. Washington St., Chicago, IL 60602, home of the Domestic Relations Division of the Circuit Court of Cook County. The presiding judge's courtroom is 1905 and the clerk's Domestic Relations office is Room 802. The division line is (312) 603-3025; the clerk's Domestic Relations office is (312) 603-6441.

Two threshold points are worth checking before you file. Venue under 750 ILCS 5/104 lies in the county where either party resides, so Cook County is correct if you live in Evanston. Under 750 ILCS 5/401, one party must have 90 days of Illinois residency, or military presence in the state, before a judgment of dissolution is entered — that is about the judgment, not about when you may file.

Which building to choose is a practical decision: where the other party lives and works, where the children are, and where counsel practices. Decide deliberately rather than by default.

What Cook County asks of parents

Parenting education. Litigating parents in dissolution and parentage cases take Focus on Children, the county's court-approved program under 750 ILCS 5/404.1 and Illinois Supreme Court Rule 924. It is a four-hour in-person class, with Spanish sessions twice a month and interpreters by arrangement; an online alternative, Children In Between Online, is available. The cost is $50 unless waived by the judge. Register through Family Court Services at (312) 603-1540 or DRD.family@cookcountyil.gov with a copy of the court order. If cost is the obstacle, raise the waiver with the judge rather than skipping the class.

Mediation. Mediation is required for the initial allocation of parental responsibilities, modification of allocation, relocation, and non-parent visitation. It is discretionary for financial and discovery disputes. Parties may use a court-certified or agreed private mediator; when they cannot agree on one for a child-related dispute, Family Court Services handles it at (312) 603-1540. That office is at 69 W. Washington St., Suite 1000, Chicago, IL 60602, and also provides evaluations, emergency intervention, and children's support groups.

A parenting plan. Under 750 ILCS 5/602.10, a parenting plan is due within 120 days after service or filing. Parents may file jointly or separately. The plan addresses decision-making under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7. Drafting early — school, holidays, exchanges, communication — narrows what mediation has to resolve.

Financial disclosure. Property is divided under 750 ILCS 5/503, maintenance is addressed under 750 ILCS 5/504 including the guideline formula at 504(b-1), and child support follows the income shares approach of 750 ILCS 5/505. All of it runs on documents: pay records, tax returns, account statements, business records. Gathering them is the most useful thing you can do this week.

Relief before the case ends. Temporary relief under 750 ILCS 5/501 covers temporary support and, under 501(c-2), exclusive possession of the marital residence. 750 ILCS 5/603.5 allows a temporary allocation of parental responsibilities, and 750 ILCS 5/603.10 allows restriction of parental responsibilities on serious endangerment. After judgment, support and allocation judgments may be modified under 750 ILCS 5/510, and a move is governed by 750 ILCS 5/609.2, which sets the trigger at more than 25 miles from Cook County.
