Venue is set by 750 ILCS 5/104: the case belongs in the county where either party resides. What the McHenry County court will expect from you

Parenting education. Under 750 ILCS 5/404.1, parents in dissolution cases attend a court-approved parenting education program, and Illinois Supreme Court Rule 924 governs how circuits run those programs. In McHenry County the program is Focus on the Kids, offered through McHenry County College. It applies to any parent in a divorce or post-divorce proceeding with minor children, and to parentage cases when the court orders it. Mediation. Contested parenting issues in the 22nd Circuit are referred to court-appointed neutral mediators through the Family Division; Illinois Supreme Court Rule 905 governs circuit mediation programs for allocation disputes. For high-conflict matters, the circuit also has a parenting coordinator program under Local Rule 11.14. Mediation covers parenting time and decision-making, not the division of property.

Your parenting plan. Under 750 ILCS 5/602.10, each parent files a proposed parenting plan within 120 days after service or filing. Start drafting it now, with a real week-by-week schedule, a holiday rotation, and who decides education, health care, religion, and extracurriculars. Decision-making is allocated under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7.

Financial disclosure. Property is divided under 750 ILCS 5/503, maintenance is decided under 750 ILCS 5/504 including the guideline formula at 504(b-1), and child support runs on the income shares method in 750 ILCS 5/505. All three depend on complete income and asset information. Begin pulling three years of tax returns, recent pay records, bank and brokerage statements, retirement account statements, and any business records now.

Relief while the case is pending. 750 ILCS 5/501 covers temporary relief, including temporary support and exclusive possession of the marital residence under 501(c-2). 750 ILCS 5/603.5 covers temporary allocation of parental responsibilities. Where a child is seriously endangered, 750 ILCS 5/603.10 allows restrictions on parental responsibilities.

Moving with the children. McHenry County is one of the counties named in 750 ILCS 5/609.2: a move of more than 25 miles from McHenry County is a relocation requiring notice and, if contested, court approval. A move of more than 25 miles out of state is also a relocation. Leaving Crystal Lake for a home a short drive away may still trigger the statute, so check the mileage before you sign a lease.

After judgment. Support and allocation judgments are modified under 750 ILCS 5/510. Post-decree work is filed back in the same Family Division in Woodstock.
