Cicero Divorce & Family Law Attorney

Illinois court-source navigation and case-specific representation

Where is a Cicero family-law case heard, and what does the court require?

Quick Answer: If you live in Cicero, your divorce, parentage, or parenting case is a Cook County case, and the suburban courthouse for your area is the Maywood Courthouse (Fourth Municipal District) at 1500 Maybrook Dr. You can also file downtown in the Domestic Relations Division at the Richard J. Daley Center; this page explains both, what Cook County asks of parents, and where to find help nearby.

Where a Cicero case is heard

Cicero sits in Cook County, and the suburban courthouse listed for the town is the Maywood Courthouse (Fourth Municipal District), 1500 Maybrook Dr., Maywood, IL 60153. Domestic relations cases are heard there. The courthouse phone is (708) 865-6040, and the posted hours are 8:30 a.m. to 4:30 p.m. The Fourth Municipal District also serves Bellwood, Berwyn, Broadview, Brookfield, Elmwood Park, Forest Park, Franklin Park, Hillside, La Grange Park, Maywood, Melrose Park, Oak Park, River Forest, Riverside, and Westchester.

A Cook County resident may instead file downtown with the Domestic Relations Division at the Richard J. Daley Center, 50 W. Washington St., Chicago, IL 60602. The presiding judge's courtroom is 1905, and the clerk's Domestic Relations office is Room 802. The Division can be reached at (312) 603-3025 and the clerk at (312) 603-6441. Because you live in a suburban municipal district, Maywood is the local option and the downtown location remains available.

Two rules set the frame. Under 750 ILCS 5/104, venue lies in the county where either party resides, which for a Cicero resident means Cook County. Under 750 ILCS 5/401, a judgment of dissolution requires 90 days of Illinois residency (or military presence) before judgment. If you have lived in Illinois less than that, you can usually still file and use the waiting period to complete disclosure and temporary relief.

What Cook County asks of you

Parenting education. Cook County runs Focus on Children for litigating parents in dissolution and parentage cases, under 750 ILCS 5/404.1 and Illinois Supreme Court Rule 924. It is a four-hour in-person class, with Spanish sessions twice a month and interpreters by arrangement; an online alternative, Children In Between Online, is available. The cost is $50 unless waived by the judge. Register through Family Court Services at (312) 603-1540 or DRD.family@cookcountyil.gov, sending a copy of the court order. Do this early rather than the week before your next date. See the parent education page.

Mediation. Mediation is mandatory for initial allocation of parental responsibilities, modification of allocation, relocation, and non-parent visitation. It is discretionary for financial and discovery disputes. When parties cannot agree on a mediator for a child-related dispute, Family Court Services handles it; otherwise you may use a court-certified or agreed private mediator. Contact (312) 603-1540. Details are on the mediation program page.

A parenting plan. Under 750 ILCS 5/602.10, a parenting plan is due within 120 days after service or filing. The plan covers significant decision-making under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7. If you and the other parent agree, you file one plan; if not, each of you files your own and the disputed points go to mediation.

Financial disclosure. Property is divided under 750 ILCS 5/503, maintenance is decided under 750 ILCS 5/504 including the guideline formula at 504(b-1), and child support follows the income shares method of 750 ILCS 5/505. All three depend on documented income and assets, so start gathering pay records, tax returns, bank and retirement statements, and business records now.

If you need something before the case is over. 750 ILCS 5/501 allows temporary relief, including temporary support and exclusive possession of the marital residence under 501(c-2). 750 ILCS 5/603.5 allows a temporary allocation of parental responsibilities. Where a child is seriously endangered, 750 ILCS 5/603.10 allows restriction of parental responsibilities. After judgment, support and allocation judgments can be changed under 750 ILCS 5/510, and a move is governed by 750 ILCS 5/609.2, which for a Cook County parent treats a move of more than 25 miles as relocation (25 miles if the move is out of state).

A useful way to spend this week: write down the date you moved to Illinois and the date of your marriage; list the accounts, properties, and debts you know about; note your children's schedule as it actually runs; and, if there has been any monitoring of your phone or accounts, stop changing settings and write down what you have noticed instead. Bring that to the screening call.

It is discretionary for financial and discovery disputes. If you cannot agree on a mediator for a child-related dispute, Family Court Services handles it at (312) 603-1540; otherwise you can use a court-certified or agreed private mediator.
