What Kane County requires of parents and spouses
Kane County front-loads two things: parent education and financial disclosure. Both run on clocks that start with your appearance or responsive pleading.
KiDs 1st parent education. Kane County's court-approved parenting education program under 750 ILCS 5/404.1 and Illinois Supreme Court Rule 924 is KiDs 1st. It applies to all parents and custodians in pending cases where allocation of parental responsibilities may be at issue, and completing it is a prerequisite to court-ordered mediation under Local Rule 14.16(c). Sessions are offered online (virtual) or in person, in English and Spanish. Register by emailing kids1st@co.kane.il.us with your case number, then complete the UPtoPARENTS tutorial and test. Mediation. Local Rule 14.16 requires mediation for allocation of parental responsibilities, parenting time, relocation and other non-economic issues involving children (see Illinois Supreme Court Rule 905). Mediators screen for impediments such as domestic violence. If there has been abuse, coercion or surveillance in your relationship, say so during screening rather than waiting for a session.
Financial affidavit. Under Local Rule 14.11, the parties exchange the Financial Affidavit within 30 days of the appearance or responsive pleading. It is not filed with the clerk, and no discovery goes out until it is served. Gathering documents is first-week work. The affidavit feeds property division under 750 ILCS 5/503, maintenance including the guideline calculation under 750 ILCS 5/504(b-1), and child support on the income shares model under 750 ILCS 5/505.
Parenting plan. Each parent files a proposed parenting plan within 120 days after service or filing (750 ILCS 5/602.10), addressing significant decision-making under 750 ILCS 5/602.5 and parenting time under 750 ILCS 5/602.7. If a move is on the horizon, relocation from Kane County is measured at more than 25 miles under 750 ILCS 5/609.2, so a move that feels local may still require notice and court approval.
Where a child's safety is at stake, 750 ILCS 5/603.10 allows the court to restrict parental responsibilities on a finding of serious endangerment. Orders of protection carry their own remedies under 750 ILCS 60/214, including emergency orders entered without prior notice under 750 ILCS 60/217. After judgment, support and allocation judgments may be modified under 750 ILCS 5/510.
